Pending release of Nebraska inmates parallels Nikko Jenkins case - WOWT

OMAHA, Neb. (WOWT) - A decade ago, Nikko Jenkins murdered four people in Omaha shortly after being released from prison.

Now, a question is raised that is chilling for those who oversee Nebraska Corrections: Is the system creating another Nikko Jenkins?

6 News has interviewed Jenkins a handful of times, and while he speaks of the god Apophis being responsible for the murders — and a number of other wild theories — the courts have repeatedly found him competent and understanding of right from wrong.

Jenkins once told 6 News that the outcomes may have been different if he had received mental health care while locked up.

Nikko Jenkins isn’t going anywhere. He remains on death row locked behind bars in Tecumseh, Nebraska.

But in 2013, Jenkins was begging anyone, from prosecutors to judges, to keep him locked up.

Jenkins said his 10 years of prison time for carjacking as a teenager didn’t address his mental health and that he feared with his pending mandatory release that he would kill more if let out of prison.

And he did.

Four people were shot dead in 10 days at the hands of Nikko Jenkins.

Doug Koebernick is the Inspector General for Nebraska Corrections, essentially the independent oversight for the state’s prison system.

The office was created because of the system’s failure with Jenkins. Lawmakers and the public alike naturally did not want a murderous rampage to happen again.

“The longer you keep people there, you’re going to see worse results from them,” Koebernick said. “You’ve got to figure out what can work for a community.”

In his annual report, Koebernick uncovered some disturbing examples.

One man has been in restrictive housing for years, meaning he doesn’t get out of his cell for more than an hour per day. It’s been that way for five and a half years.

That inmate will “jam out” this December, which is a term used for someone released directly into the community without any oversight.

“I’m not saying these people who are released will be like Nikko Jenkins, but we have an individual in restrictive housing who has been there for 2,000-plus days and another for more than 1,400 who are scheduled to walk away out the front door,” Koebernick said. “It’s a very serious situation and you’re trying to help them succeed and keep the public safe.”

Another individual has been in long-term restrictive custody for nearly four years — most of his sentence. He’s scheduled to be let out in December, also without any oversight.

6 News contacted the Nebraska Department of Corrections to see if they have a plan in place to help with the transition of these two men back into the community.

NDCS did give 6 News this statement:

The individuals referenced in the report both have transition plans in place. In addition, reentry plans will be in place for them. To the extent possible, connections with community reentry providers and others will be made prior to release.

Officials also told 6 News over the last several months, the number of individuals housed in restrictive housing for over six months has dropped by about 35%.

A report from the Nebraska Corrections Inspector General revealed some potentially dangerous possibilities.

The Union Cabinet has cleared the Women's reservation bill to be tabled in the Lok Sabha. The development comes amid a special five-day session of the Parliament.

Women MPs account for less than 15 per cent of Lok Sabha strength while their representation is below 10 per cent in many state assemblies, data shows for the women reservation bill pending for nearly 27 years.

The last concrete development on the issue was in 2010 when Rajya Sabha passed the bill amid marshals escorting out some MPs who opposed the move to reserve 33 per cent seats for women in Lok Sabha and state assemblies, but the bill lapsed as it could not be passed by Lok Sabha.

While the BJP and the Congress have always supported the bill, opposition by other parties and demands from some for quota for backward classes within the women's quota have been key sticking points.

Several parties on Sunday made a strong pitch for bringing and passing the women's reservation bill in the five-day Parliament session beginning Monday, but the government said an "appropriate decision will be taken at the appropriate time".

In the present Lok Sabha, 78 women members were elected which account for less than 15 per cent of the total strength of 543.

In Rajya Sabha too, women's representation is about 14 per cent, according to the data shared by the government with Parliament last December.

Several state assemblies have less than 10 per cent women representation, including Andhra Pradesh, Arunachal Pradesh, Assam, Goa, Gujarat, Himachal Pradesh, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Manipur, Meghalaya, Odisha, Sikkim, Tamil Nadu, Telangana, Tripura and Puducherry.

Bihar, Haryana, Punjab, Rajasthan, Uttrakhand, Uttar Pradesh and Delhi had 10-12 per cent women MLAs, according to the government data of December 2022. Chattisgarh, West Bengal and Jharkhand led the charts with 14.44 per cent, 13.7 per cent and 12.35 per cent women MLAs, respectively.

In the last few weeks, several parties including the BJD and the BRS have demanded reviving the bill, while Congress also passed a resolution at its Hyderabad Congress Working Committee meeting on Sunday.

While it's not known what percentage of reservation can be proposed in a new bill, the 2008 Bill, which was passed in Rajya Sabha in 2010 before it lapsed following the dissolution of Lok Sabha, proposed reserving one-third of all seats in Lok Sabha and legislative assemblies in each state for women. The UPA was in power when the last attempt was made to pass the bill.

According to a write-up available on PRS Legislative, it also proposed quota-within-quota for SCs, STs and Anglo-Indians, while reserved seats were to be rotated after each general election.

It meant that after a cycle of three elections, all constituencies would have been reserved once.

The reservation was to be operational for 15 years.

Before the failed attempt of 2008-2010, the issue had a chequered history as a similar bill was introduced in 1996, 1998 and 1999.

A Joint Parliamentary Committee chaired by Geeta Mukherjee had examined the 1996 Bill and made seven recommendations.

Five of these were included in the 2008 Bill, including the 15-year reservation period and sub-reservation for Anglo Indians.

These also included reservation in cases where a state has less than three seats in Lok Sabha (or less than three seats for SCs/STs); reservation for the Delhi assembly; and changing “not less than one-third” to “as nearly as may be, one-third”.

Two of the recommendations were not incorporated in the 2008 Bill; the first was for reserving seats in Rajya Sabha and Legislative Councils and the second was for sub-reservation for OBC women after the Constitution extends reservation to OBCs.

The 2008 Bill was referred to the Standing Committee on Law and Justice, but it failed to reach a consensus in its final report.

The Committee recommended that the Bill “be passed in Parliament and put in action without further delay".

Two members of the Committee, Virender Bhatia and Shailendra Kumar (both belonging to the Samajwadi Party) dissented stating that they were not against providing reservation to women but disagreed with the way this Bill was drafted.

They had recommended that every political party must distribute 20 per cent of its tickets to women, the reservation should not exceed 20 per cent of seats and there should be a quota for women belonging to OBCs and minorities.

The standing committee also considered other methods of increasing representation.

One suggestion was to ask political parties to nominate women for a minimum percentage of seats, but the committee felt that parties could bypass the spirit of the law by nominating women to seats where there were prospects of loss.

Another recommendation was to create dual-member constituencies, with women filling one of the two seats from those constituencies.

The Committee believed that this move could “result in women being reduced to a subservient status, which will defeat the very purpose of the Bill”, the PRS said.

The Committee concluded that the issue of reservations to Rajya Sabha and Legislative Councils needed to be examined thoroughly as the upper houses play an equally important role under the Constitution.

On the issue of reservation to OBC women, the Committee said that “all other issues may be considered at an appropriate time by the government without any further delay at the present time in the passage of the Bill”.

The 2008 bill was opposed by SP, RJD and JD(U), though parties have publicly expressed their support for it.

The government will need two-thirds support in each House of Parliament for the bill to be taken up for consideration and passing.

Many feel it is not possible to reserve seats in Rajya Sabha due to the existing system of elections to the upper house.

Members of state assemblies elect Rajya Sabha MPs through a single transferable vote, which means that the votes are first allocated to the most preferred candidate, and then to the next preferred candidate, and so on.

This system cannot accommodate the principle of reserving a certain number of seats for a particular group. Currently, Rajya Sabha does not have reservations for SCs and STs.

Therefore, any system that provides reservation in Rajya Sabha implies that the Constitution must be amended to jettison the Single Transferable Vote system.

Charges pending after head-on crash I-840 killed 2, THP identifies victims - WSMV 4

NASHVILLE, Tenn. (WSMV) - The two people killed in a head-on crash on Interstate 840 in Wilson County have been identified.

According to the Tennessee High Patrol’s preliminary crash report, the crash happened at mile marker 69 between Stewarts Ferry Pike and Couchville Pike at about 12:15 p.m. on Thursday.

THP reports 52-year-old Kenya Moore, of Tennessee, and 75-year-old David Daugherty, of Florida, were both killed in the crash.

The report states that a 2007 Jeep Laredo, driven by Clarence Moore, 75, was traveling east on I-840 when it crossed the median and struck the 2002 Chevy Suburban driven by Daugherty.

Kenya Moore was a passenger in the Jeep, Charges are pending against Clarence Moore, who also sustained injuries from the crash.

Fort Bend County captain relieved of duty pending investigation, officials say - Houston Chronicle

A division leader with the Fort Bend County Sheriff’s Office has been relieved of duty because he was named in an ongoing investigation by the Houston Police Department, officials with the office told the Chronicle.

Nasir Abbasi was relieved of duty Aug. 15, pending the outcome of an investigation with the special investigations unit of the Houston Police Department, said Michelle Domengoni, spokeswoman for the Fort Bend County Sheriff’s Office.

Officials with the Houston Police Department declined to confirm whether Abbasi was subject to investigation, or any details connected to the alleged investigation.

David Kiatta, an attorney representing Abbasi, said he and his client were cooperating with law enforcement and hoped to have the matter resolved shortly. 

Abbasi made headlines in 2021 when the sheriff’s office promoted him to captain, making him the first person of South Asian descent to rank as captain in a sheriff’s office, according to a report at the time from ABC13.

The sheriff’s office administrator was the commander of the regulatory affairs division, which included management of records, alarms, game rooms and racial profiling, according to a 2022 report. The man was born in Pakistan and immigrated to the United States as a 24-year-old, according to his profile on the sheriff’s office’s website.

He moved to Houston in 2008 and joined the Harris County Precinct 7 Constable’s Office as a 42-year-old patrol deputy before joining the Harris County Sheriff’s Office in 2011.

Monthly home prices have hit an all-time high in recent weeks, driving down pending home sales by as much as 28%. 

According to recent data from Redfin, the median monthly mortgage payment hit $2,632 during the four weeks ending Sept. 10, when borrowing rates sat at 7.12%, 

Mortgage buyer Freddie Mac reported that the 30-year fixed rate mortgage rate declined slightly from August’s two-decade high, but it’s still hovering above 7% for the fourth consecutive week. 

"Though while inflation has decelerated, firmer economic data have put upward pressure on mortgage rates which, in the face of affordability challenges, are straining potential homebuyers," Freddie Mac Chief Economist Sam Khater said.

Prime Minister Narendra Modi on Thursday lauded Chief Justice D Y Chandrachud after he announced that the Supreme Court will soon be linked to the National Judicial Data Grid (NJDG), saying such harnessing of technology will further transparency and enhance the justice delivery system in the country.

Chandrachud announced that the apex court will soon be linked to the NJDG, a repository of data relating to pendency of cases and disposal rate of courts right from the taluka level to the national level. At present, the portal shows data only up to the high court level.

As the CJI started the day's proceedings in the court, he said the top court's data will be uploaded on the NJDG on a real-time basis.

Hailing the development, Modi said on X: "Laudatory step by the Supreme Court and CJI DY Chandrachud Ji. Such harnessing of technology will further transparency and enhance the justice delivery system in our country."

ATLANTA, Ga. (Atlanta News First) - A pending decision from the Food and Drug Administration regarding popular common nasal decongestants could disrupt the over-the-counter medication market, pharmacists warn.

An FDA advisory panel voted unanimously Tuesday against the effectiveness of the key drug found in popular versions of Sudafed, Dayquil, and other medications stocked on store shelves. The 16-person panel concluded oral medicines containing phenylephrine don’t work to get rid of nasal congestion.

The advisers came to the decision after looking at research that shows when taken orally, only a small amount of the drug reaches the nose. It does not include nasal sprays and prescription medication.

Ira Katz, owner of Atlanta’s Little Five Points, said he wasn’t surprised by the panel’s decision. However, he warned the removal of the ingredient could “wreak havoc” on over-the-counter products this cold and flu season.

“If they take it off, all of these products are going to have to be revamped, totally revamped and the cost to the manufacturers will be exuberant which will be trickled down to the consumer,” Katz said.

Phenylephrine became the main drug in over-the-counter decongestants 15 years ago when regulators learned an older ingredient was being used to make methamphetamine.

The FDA has not indicated when it will make a final decision on the matter but the agency typically sides with its advisory committees.

Air Force plans microreactor at Alaska base pending NRC approval - Stars and Stripes

The Air Force announced its intent recently to award a contract for a small nuclear reactor at a base in Alaska pending approval of the plan by the Nuclear Regulatory Commission.

The contract went to Oklo Inc., of Santa Clara, Calif., for a small reactor at Eielson Air Force Base, a fighter base 110 miles from the Arctic Circle, according to the company and an Air Force news release Aug. 31.

The Air Force micro-reactor pilot program is looking to deploy a small reactor that is capable of producing up to 20 MW.

By comparison, the R. E. Ginna Nuclear Power Plant in New York, the smallest of its kind in the United States, has a generating capacity of 582 MW, according to the Energy Information Administration.

The reactor pilot project is part of a mandate in the 2019 National Defense Authorization Act that at least one licensed microreactor is operating on a Defense Department installation by 2027. The Air Force said the Eielson project may determine the viability of microreactor use at its installations.

Oklo Inc. will design, build, own and operate its Aurora model microreactor at Eielson, according to the Air Force.

The company estimated the cost to build the microreactor at about $60 million and another $3 million per year to operate and maintain.

Construction of the power plant will cost the Air Force nothing upfront, Mark Correll, deputy assistant secretary of the Air Force for environment, safety and infrastructure, said in October 2021 report by Juneau, Alaska, broadcaster KTOO. 

The Air Force will buy the plant’s electricity at “a rate that’s competitive with what the base pays now,” Correll said. The Air Force expects to pay for 39,420 MW annually, according to the request for proposals.

But first, Oklo must obtain a license to operate the reactor, which the regulatory commission denied the company last year, according to a Jan. 6, 2022, NRC letter to company CEO Jacob DeWitte.

The regulatory commission had no concerns about the reactor design’s safety or security, or the application’s merits, according to the letter on the NRC website.

But Oklo failed to provide “substantive information” on the “maximum credible accident for the Aurora design, the safety classification of structures, systems, and components” in response to requests from commission staff, the letter states.

The maximum credible accident refers to the worst-case accident scenario, a useful tool for identifying potential hazards in a reactor design, according to the U.S. Department of Energy website.

An Oklo spokeswoman said the company is addressing the NRC concerns.

“Oklo proposed a licensing pathway in its response to the requests for proposals and is already beginning discussions with the Air Force regarding the optimal licensing steps for this particular location and use case,” spokeswoman Bonita Chester told Stars and Stripes by email on Sept. 7.

 The Aurora microreactor is equipped with built-in safety features that self-adjust to changing conditions and demands to prevent overheating, according to the Air Force.

“This pilot is imperative to the future implementation scalability of micro-reactors and the DoD will be working with other military departments to identify additional installations for the deployment of US-developed advanced nuclear tech,” Chester said.

The Pentagon is also considering a microreactor on Guam, a linchpin of U.S. military defense in the Pacific where personnel of every service are stationed. The reactor would supplement existing power sources on the island, where a typhoon in June left many residents without power for days.
