Government Contracts attorneys Erin Estevez, Jeremy Burkhart and Kelsey Hayes co-authored an article for Pratt's Government Contracting Law Report exploring how transactions can affect a contractor's ability to compete for an award and what steps contractors can take to mitigate these effects. Their article analyzes two bid protests decision from the Government Accountability Office (GAO) that reached opposite conclusions on whether a procuring agency properly considered the impact that a corporate transaction would have on pending procurements. The authors also look at two decisions that concerned how a transaction affects a small business offeror's certification and recertification obligations.
