First Judicial District Judge Jason Lidyard has placed William Macinnes, 19, of Los Alamos on 24/7 house arrest with an electronic monitoring bracelet with exceptions only for medical appointments, meetings with his legal counsel and/or Court appearances. He has also been placed on standard pre-trial conditions pending a docket call set for Nov. 28. He is also forbidden by the Court to have contact with anyone under the age of 18.
Macinnes was arrested Sept. 2 and charged with two counts of criminal sexual penetration of a child under 13, one count of criminal sexual contact (unclothed) with a child under 13 and one count of criminal sexual contact (clothed) with a child under 13. Court documents indicate that the child involved is 4 years old and attended Little Forest Playschool in Los Alamos where Macinnes was employed at the time of the alleged offenses.
The case was bound over to District Court after Macinnes waived his preliminary hearing in Magistrate Court. He also waived arraignment in District Court and his attorney, Larissa Breen with the Dan Cron Law Firm, entered a plea of not guilty on his behalf.
If convicted of the two criminal sexual penetration charges, Macinnes faces on each count 18 years imprisonment and/or a $15,000 fine. The criminal sexual contact (clothed) charge is punishable by six years imprisonment and/or a $5,000 fine. The criminal sexual contact (unclothed) is punishable by 15 years imprisonment and a $12,500 fine.
Little Forest Playschool has been closed pending the outcome of a state hearing Friday, September 9.
