Rosendale OKs cannabis growers showcases pending inspection, state OK - The Daily Freeman

ROSENDALE, N.Y. — The Town Board gave conditional approval for two pop-up cannabis farmers showcases in the former Esso gas station and Stone Krafters building at 2223 state Route 32 later this month.

Town Board members during a meeting Wednesday granted the permit on the condition that a fire inspection be completed and state authorization is received.

Among concerns for applicant Edward Parker is whether the fire code inspection can be completed soon enough for the state Office of Cannabis Management to review the town approvals.

“I’ve done all the paperwork that’s requested, I have all the insurance, the only issue I have is with the fire marshall who can’t get there until (it’s too late) for the state to process,” he said.

Parker said the inspection is scheduled for Dec. 19 and the showcases are proposed the weekends of Dec. 22-24 and Dec. 29-31.

Parker expects it would take about two weeks to have the state review information, which can begin before the fire inspection, but it’s likely to need more than a window of two days for final approval.

“It’s just one form and it’s all set up electronically … so you put the town letterhead on it,” he said. “If we don’t get the inspections … you can cancel.”

In the application, Parker wrote that the event would be called the Holiday Cannabis Growers Showcase and have a staff of eight people.

Officials were told that there would be parking for about 30 cars and about 200 people would arrive each day with stays of up to a half-hour.

Hearing set on pot rules

In a related matter, board members voted to schedule a public hearing for Jan. 10 to review a proposed zoning amendment to regulate cannabis-related businesses. The law, which would be intended for permanent businesses, was previously subject to public comments during hearings in October and November.

Under the proposed regulations:

• Businesses would need a site plan approval and special use permit regardless of a building’s previous use.

• Businesses would have to be at least 500 feet from a school, daycare facility, other cannabis establishments, drug or alcohol rehabilitation facility or places of worship.

• On-site cannabis businesses that allow consumption could not be in a facility where there are other property uses.

• Cannabis businesses could not be within a trailer, cargo container, motor vehicle or similar nonpermanent enclosure.

• On-site use businesses could operate between 11 a.m. and midnight, while dispensaries could operate from 9 a.m. to 9 p.m.
